Health sector regulator Monitor has announced that it is investigating whether Tees, Esk and Wear Valleys NHS Foundation Trust has breached conditions of its licence.

The health sector regulator is launching the investigation following the decision of the Care Quality Commission (CQC) to issue the Trust with a warning notice for failing to meet standards in respecting and involving people who use services.

Monitor’s investigation will examine whether the issues highlighted by the Care Quality Commission are indicative of governance problems at the Trust.  The investigation is taking place under Monitor’s new provider licence regulatory regime which came into force on April 1st 2013. This aims to protect and promote patients’ interests.

The health sector regulator will ask the Trust to explain why they have experienced problems and what plans they have to address them. If Monitor finds the Trust to be in breach of its licence conditions we may require them to take specific actions to address the issues quickly and effectively.

Monitor and the CQC recently signed a joint Memorandum of Understanding which formalised how we share information.

Yvonne Mowlds, Regional Director at Monitor, said:

“The investigation we are launching today is another example of how we are working closely with the CQC to protect the interests of patients. The CQC highlighted an issue with the care patients are receiving and we are now asking the Trust to explain what they are doing to put things right.

“Patients expect to see their services run well and by investigating at this early stage we can make sure that the Trusts are able to address any issues quickly and effectively.”
